Apple has initiated legal proceedings against OpenAI, filing a lawsuit in a US federal court with accusations that the artificial intelligence firm has unlawfully used its confidential trade secrets. The tech giant claims that OpenAI has accessed sensitive information concerning Apple’s hardware development, manufacturing practices, and supply chain operations.

The core of Apple’s allegations centers around former employees who transitioned to roles at OpenAI, purportedly taking with them proprietary knowledge that has been shared with their new employer. This, Apple argues, has provided OpenAI with an undue edge in developing its speculated consumer AI hardware products. The complaint details accusations of former employees accessing confidential data, approaching Apple’s suppliers, and seeking sensitive information during recruitment processes.

Specific individuals named in the lawsuit include Chang Liu, accused of not returning a work laptop issued by Apple upon his departure, and Tang Yew Tan, a former senior executive at Apple who moved on to serve as OpenAI’s Chief Hardware Officer. Apple alleges that Tan engaged in discussions with OpenAI affiliates and Apple suppliers before leaving the company, further fueling concerns of trade secret misappropriation.

Apple’s claims extend to a broader accusation that OpenAI and its affiliates have systematically targeted Apple’s proprietary technology and expertise in manufacturing, product development, and supply chain management to fast-track their entrance into the consumer AI hardware market. The lawsuit underscores that over 400 former Apple employees are now part of OpenAI’s workforce. Despite raising these issues directly with OpenAI, Apple states it has yet to receive a response.

In its legal action, Apple is pursuing both preliminary and permanent injunctions to halt the alleged misuse of its trade secrets. Additionally, the company is seeking financial compensation for what it describes as the deliberate and malicious appropriation of its confidential business information. As of now, OpenAI has not issued a public statement regarding the allegations laid out by Apple.
